The Liberian Judiciary System – An Overview
It is important to state that the Liberian system of government is republican with three equal coordinate branches, namely the Legislature, the Executive and the Judiciary. The legislature is the rule making body and it is bicameral with the senate and the House of Representatives; the executive is headed by an elected President who is limited to two terms of six years and it is the enforcement or administrative branch of government; and the judiciary is the adjudicative and interpretive branch of government making the Liberian government a three-branch system.
The Liberian Judiciary is headed by the Supreme Court which is comprised of five judges who are called Justices; it both a constitutional court and the apex court of Liberia. The justices are nominated by the President, confirm by the Senate and appointed President before taking their seat.
As per the dictate of the Constitution of Liberia of 1986, the Chief Justice heads the Supreme Court and the Judiciary Branch of the Liberian Government. The Chief Justice administers the oath of office to the elected President and to all who succeeds to the presidency of Liberia. The Chief Justice and all Justices of the Supreme Court and all judges of subordinate courts are retired at the age of seventy as per the Constitution of Liberia.
Below the Supreme Court of are Circuit Courts and Specialized Courts of record which includes, Probate Courts, Labor Courts, Criminal Courts, Commercial Courts etc; these are the tier directly below the Supreme Court and decisions from there are appealed directly to the Supreme Court. The Liberian government is divided into counties for administrative purposes and accordingly every county has a circuit court and wherever there are circuit court there are specialized court as well.
The court of first instant is the magistrate; they are appointed for a term of four years which is renewable based on good performance and behavior. Magisterial courts are found all over the country as the first level of interventions for dispute resolution.
Matters from all circuit courts and all specialized court of circuit level go straight to the Supreme Court as the Constitution of Liberia did not create intermediate level courts or appellate high court below the Supreme Court and higher than the circuit.
All the circuit courts and specialized courts of circuit level have single judges, however, in response to the increasing level of commercial activities in Liberia, the Legislature created the Commercial Court with a three judges panel, the first and only such court in Liberia besides the Supreme Court with a panel of judges. And at the moment there is only one Commercial court based in Monrovia.
